In the aftermath of massive data breaches that have impacted hundreds of millions of consumers, states are looking to pass more robust data privacy and cybersecurity laws. Companies are concerned that the laws go too far, requiring massive investments in renewed compliance efforts. Consumers are concerned that the laws do not go far enough, and do not provide adequate compensation in the event of a breach or privacy violation. This course will discuss the current legal landscape of data and privacy laws in the United States, as well as new laws that could create longstanding precedent.

This segment will explore both how to structure and settlements and also how to management them once received. Clients and attorneys may opt for a structure, lump sum or some combination. We will review the potential benefits and pitfalls of each. Understanding the different types of financial advisory arrangements and the associated expense is critical in making the most appropriate choices for clients both from a practical and fiduciary standpoint. What appears to be the lowest cost alternative may not be the most appropriate or even the least expensive when all factors are considered. The presentation will also compare and evaluate different compensation models including: fee based, commission based, hybrid and internal. We will also discuss some of the new arrangements for splitting fees between advisers and attorneys. As always time will be allocated for participant questions.
